Welcome to Eva. These Terms of Service ("Terms") are an agreement between you and the operator of Eva ("Eva", "we", "us"). Please read them carefully. By creating an account or using the app, you agree to these Terms.
By downloading, accessing, or using Eva, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the app.
You must be at least 18 years old to use Eva. By using the app, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into these Terms.
Eva is a software application that uses artificial intelligence to hold voice and text conversations for companionship. Eva's responses are generated automatically and may be inaccurate, incomplete, or inappropriate. You should not rely on Eva for factual accuracy or as a source of professional advice.

Always seek the advice of a qualified professional for medical, mental-health, legal, or financial matters, and never disregard professional advice or delay seeking it because of something Eva said.
To use Eva you create an account with your email address and sign in using a one-time verification code. You are responsible for keeping access to your email secure and for all activity that happens under your account. Please let us know promptly if you believe your account has been used without your permission.
You agree not to use Eva to:
We may suspend or terminate your access if you misuse the app or violate these Terms.
The messages and voice input you provide ("your content") remain yours. You grant us a limited license to process your content solely to operate and provide the app to you — for example, to generate responses, transcribe your speech, and maintain your conversation history — as described in our Privacy Policy. We do not sell your content or use it for advertising.
The Eva app, including its software, design, and branding, is owned by us and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use Eva for your own personal, non-commercial use, subject to these Terms. You may not copy, modify, distribute, or create derivative works from the app except as permitted by law.
Eva relies on third-party providers to function (for example, for AI responses, speech processing, and hosting). Your use of the app may be subject to those providers' terms, and we are not responsible for their services. The app is also distributed through the Apple App Store and is subject to Apple's applicable terms.
Eva is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, secure, or that Eva's responses will be accurate or reliable. You use Eva at your own discretion and risk.
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) Eva. To the fullest extent permitted by law, our total liability for any claim relating to the app will not exceed the greater of the amount you paid us to use Eva in the twelve months before the claim, or USD $50.
You may stop using Eva and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the app. You can request deletion of your account and data by contacting support@evalives.com. Sections that by their nature should survive termination (such as disclaimers and limitation of liability) will continue to apply.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, notify you in the app. Your continued use of Eva after an update means you accept the revised Terms.
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict-of-laws rules, except where applicable consumer-protection laws of your place of residence provide otherwise. Any disputes will be resolved in the courts located in that state, unless applicable law requires otherwise.
